Your access to and use of our Service is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service, and a penalty may be applied.
Our Service may contain links to third-party websites or services not owned or controlled by Himalaya Heart Treks & Expedition Pvt Ltd. We do not provide links to spam or corrupt websites.
Himalaya Heart Treks & Expedition Pvt Ltd has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Your contract with us is subject to these booking conditions. A contract exists once you have paid your deposit and we have issued our booking confirmation. If any part of our contract is found invalid or unenforceable, the remainder will remain valid and enforceable.
When you make a booking, you guarantee you have the authority to accept these terms on behalf of your party. All bookings must be made by a person aged 18 or over. The lead name will be responsible for making all payments due to us.
Completion and submission of our Booking Form confirm that you have read, understood, and accepted these booking conditions.
Flights may be delayed or canceled due to weather or other factors beyond our control. In such cases, you are responsible for covering your accommodation and food costs. Himalaya Heart Treks & Expedition assumes no responsibility for changes due to factors beyond our control. Any expenses for accommodation, food, etc., will not be covered for changes outside the itinerary provided.
We accept last-hour bookings with 100% payment 7 days before the tour start date for Nepal trips. Bhutan and Tibet trips require at least 2 weeks' payment in advance.
If you need to cancel your trip, the following fees apply:
Exceptions may be made if genuine proof is provided. If you need to leave the tour early, you are responsible for all expenses incurred.
No refunds are given if the company needs to reroute to other areas due to unavoidable circumstances.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason, including breach of terms. All provisions that should survive termination shall remain in effect.
Trekkers must have appropriate travel and trekking insurance or sufficient funds to cover personal injury, death, medical expenses, and repatriation expenses. This includes costs for descending due to illness.
Accommodations are arranged in hotels, lodges, guest houses, resorts, tea houses, or camping, depending on the trip. The length of each day's trek may vary due to factors beyond our control. We may need to reroute or cancel trips due to these conditions.
These terms are governed by the laws of Nepal. Our failure to enforce any right or provision will not be considered a waiver of those rights. If any provision is held invalid, the remaining provisions will remain in effect.
We reserve the right to modify or replace these Terms at any time. Material changes will be provided with at least 30 days' notice. By continuing to use our Service after the revisions become effective, you agree to be bound by the revised terms.
The remaining balance can be paid upon arrival in Nepal. Credit card payments incur a 3-4% handling charge. Cheque or bank transfer payments do not incur handling charges. A 30% deposit of the package tour cost is required in advance.
Our tour escort/trekking guide has full authority during trekking and tours. Negative behavior or unlawful acts will result in immediate removal from the tour without refund. We expect all participants to be eco-friendly and respectful of local cultures.
Your personal data is protected under GDPR and the Data Protection Act 2024. We will only process your data in accordance with our Privacy Policy. If you have complaints about the handling of your data, please contact us at info@himalayaheart.com.
If you encounter difficulties during your trip, we will provide appropriate support, including information on health services and consular assistance. Costs incurred due to your actions will be your responsibility.
Excursions booked during your trip are not included in our package and are governed by the operator providing them. We are not responsible for any incidents during these excursions.
Fees are non-refundable if trekkers cannot complete the trek. Consult a medical professional before participating in any trek. Exceptions may be considered at our discretion. Third-party costs are also non-refundable.
